This User Agreement ("Agreement") is a legally binding contract between you ("User" or "You") and CalmAromaCo ("we", "us", or "our"), a provider of aromatherapy products. By accessing, browsing, or using our website (the "Site") and placing orders for products (the "Products"), you acknowledge that you have read, understood, and agreed to be bound by all terms and conditions set forth herein. If you do not agree to these terms, please refrain from using the Site and our services.
To use our services and place orders, you must be at least 18 years of age or have the legal capacity to enter into a binding contract under applicable law. By placing an order, you represent and warrant that you meet this eligibility requirement and that all information you provide to us is accurate, complete, and current.
2.1 When you place an order through the Site, you are making a binding offer to purchase the Products specified in your order. We reserve the right to accept or reject your order in our sole discretion, including but not limited to cases of incorrect product pricing, product unavailability, or suspicious order activity.
2.2 Upon receiving your order, we will send you a confirmation email acknowledging the receipt of your order. This confirmation does not constitute acceptance of your order. A binding contract between you and us will only be formed when we send you a second email confirming that your order has been processed and shipped ("Shipping Confirmation").
2.3 We may contact you to verify your order details or request additional information to process your order. Failure to provide such information in a timely manner may result in delays or cancellation of your order.
3.1 We exclusively offer Cash on Delivery (COD) as the payment method for all orders. No advance payment or online payment is required. You will be required to pay the full order amount (including any applicable taxes and delivery fees) in cash to the delivery personnel upon receipt of your Products.
3.2 You acknowledge and agree that the delivery personnel will not accept credit cards, debit cards, mobile payment apps, or any other non-cash payment methods. Failure to provide the required cash at the time of delivery may result in the refusal of delivery and cancellation of your order.
3.3 The order amount specified in your order confirmation is final, unless there is a typographical error in pricing. In the event of a pricing error, we will notify you promptly and offer you the option to cancel the order or proceed with the corrected price.
4.1 We will arrange for delivery of the Products to the delivery address you provide during the order placement process. You are responsible for ensuring that the delivery address is accurate and complete. We are not liable for delays or non-delivery caused by incorrect or incomplete address information.
4.2 We will make reasonable efforts to deliver the Products within the estimated delivery timeframe specified on the Site. However, we do not guarantee specific delivery dates, and delivery times may be affected by factors beyond our control, such as weather conditions, traffic, or logistical issues. We will notify you of any significant delays in delivery.
4.3 The risk of loss, damage, or deterioration of the Products passes to you upon delivery. You are encouraged to inspect the Products at the time of delivery to ensure they are in good condition and conform to your order. If you notice any damage or discrepancies, you must notify the delivery personnel immediately and contact our customer support within 24 hours of delivery.
5.1 If you are not satisfied with the Products, you may request a return and refund within 7 calendar days of delivery, provided that the Products are unused, unopened, and in their original packaging with all tags and labels intact.
5.2 To initiate a return, you must contact our customer support team via email with your order number, a description of the issue, and photos of the Products (if applicable). Our team will review your request and provide you with return instructions if approved.
5.3 For defective, damaged, or incorrect Products, we will cover the cost of return shipping and process your refund within 3-5 business days of receiving the returned Products. For non-defective Products, you will be responsible for the return shipping costs, and a full refund (excluding return shipping fees) will be processed upon receipt and inspection of the returned Products.
5.4 Refunds will be issued in the form of cash or bank transfer, as mutually agreed upon. We will require your bank account details for bank transfer refunds, and you acknowledge that we will handle such information in accordance with our Privacy Policy.
6.1 You agree to use the Site and our services in a lawful and responsible manner, and to comply with all applicable laws and regulations.
6.2 You are responsible for maintaining the confidentiality of any account information (if you create an account on the Site) and for all activities conducted under your account. You agree to notify us immediately of any unauthorized use of your account.
6.3 You shall not use the Site to post, transmit, or distribute any unlawful, harmful, defamatory, obscene, or otherwise objectionable content, or to engage in any activity that may disrupt or damage the Site or our services.
All content on the Site, including but not limited to text, images, logos, trademarks, product names, and software, is the exclusive intellectual property of CalmAromaCo or its licensors. You are granted a limited, non-exclusive, non-transferable license to access and use the Site for personal, non-commercial purposes only. You shall not copy, reproduce, distribute, modify, or create derivative works of any Site content without our prior written permission.
8.1 To the maximum extent permitted by applicable law, CalmAromaCo shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to loss of profits, loss of data, or loss of goodwill, arising out of or in connection with your use of the Site, our services, or the purchase or use of the Products.
8.2 Our total liability to you for any claims arising out of this Agreement shall not exceed the total amount paid by you for the Products giving rise to the claim.
8.3 Nothing in this Agreement shall exclude or limit our liability for fraud, willful misconduct, gross negligence, or liability that cannot be excluded by applicable law.
We collect, use, and protect your personal information in accordance with our Privacy Policy, which is incorporated into this Agreement by reference. By agreeing to this Agreement, you also agree to the terms of our Privacy Policy.
We reserve the right to modify or update this Agreement at any time. Any changes will be posted on the Site with a revised "Last Updated" date. Your continued use of the Site and our services after the posting of changes constitutes your acceptance of the modified Agreement. We encourage you to review this Agreement periodically.
We may terminate or suspend your access to the Site and our services at any time, without prior notice, if you violate any terms of this Agreement. Upon termination, all rights and licenses granted to you under this Agreement shall cease, and you shall immediately discontinue use of the Site.
